A magistrate has given a stern warning to a tradie who posted a naked picture of a woman to Facebook without her consent after a heated argument.

A former concreter who shared a naked photo of a woman in the shower on social media after an explosive argument has been given a stern warning from a magistrate.

Saia Tuitahi Haukoloa, 31, appeared before Bankstown Local Court on Tuesday and pleaded guilty to intentionally distributing, recording and threatening to record intimate images without consent.

In documents tendered to Bankstown Local Court, about 5:30pm in July, the victim picked up Haukoloa from the Belmore Hotel and drove to a unit in Burwood.

Haukoloa started arguing with the victim inside, and she recorded the exchange on her phone for her safety, police facts state.

“The argument started to escalate where the victim requested the Haukoloa to get out of the house, but he refused to do so,” the facts said.

The tradie continued to yell, scream and argue with the woman as she stood in her bedroom hallway.

He allegedly shoulder-charged her to get into the bedroom and caused pain to her left arm, according to police facts.

Haukoloa refused to leave, told the woman he had a video of her showering, and threatened to upload the footage to Facebook.

Unbeknown to the victim, he uploaded the video to his Facebook story a short time later.

According to the facts, the video was taken around two weeks prior when the victim Facetimed Haukoloa in the shower while he was away. She was unaware he recorded the video call.

“When the victim realised Haukoloa uploaded her naked photo, and she became very upset, contacted triple-0 and yelled out for him to get out of the house,” the facts state.

Police officers arrived at the Burwood unit and arrested Haukoloa for assault.

Haukoloa denied assaulting the victim to officers at Campsie station but admitted to recording the victim without her consent and uploading the video without her consent.

Magistrate Shane McAnulty advised Haukoloa, who is on a working visa, to “don’t take photos. It’s as simple as that.”

“You can’t take photos and say you will send it somewhere else. That will get you into trouble,” he said.

Mr McAnulty lectured Haukoloa and warned that if his behaviour continued, he could land behind bars.

“Next time when you have an argument, put your hands in your pocket and go for a walk and don’t make threats to people,” he said.

“While you said things you wish you hadn’t, but if you do it again, you might find yourself in jail.”

Haukoloa was convicted and sentenced to a community correction order for two years.
