A man who was once shot repeatedly in his own driveway in front of his young daughter now stands accused of an attempted murder at a Sydney unit block.
Rabie Daher is accused of the stabbing attack which was so savage the victim was not expected to survive his injuries.
Daher’s bloody fingerprints were allegedly found on the walls of a Brighton Le Sands unit block after the midnight attack on January 11 which left a 24-year-old man with critical injuries.
The 37-year-old appeared before Magistrate Philip Stewart at Central Local Court charged with wounding with intent to murder and intentionally causing grievous bodily harm after police tapped his phone and allegedly caught him discussing the brutal incident.
“(Daher) talks about sitting behind the victim while at Centrelink in Hurstville and that’s since been confirmed by CCTV,” Mr Stewart read from the alleged facts.
“He has another conversation in which he says ‘do you know what happened to him at Brighton’ before he says in Arabic ‘that was me’.”
Mr Stewart refused Daher bail, saying he was not satisfied police had a weak case against Daher or that disruption caused by coronavirus was sufficient to justify his release.
Daher will return to Central Local Court on June 11.
However, Daher’s solicitor David Leamey said the Riverwood man had only been in a scuffle with the stabbing victim and there was no evidence he had ever picked up a weapon.
“He is alleged to have been in a fist fight with the victim where a third party has tried to break them up,” Mr Leamey told the court.
“He says the co-accused pulled a knife and stabbed the victim – someone else has intervened and taken matters into their own hands.”
Mr Leamey said Daher would also argue he would not have been strong enough to stab the victim after a string of incidents leaving him with significant injuries.
In July 2017 Daher was shot several times in his Peakhurst driveway in what police then believed was a targeted attack.
The court also heard he was left with a brain injury and further physical injuries after a serious motorbike accident in 2018.
Daher is the second man charged in relation to the alleged attempted murder after Ali Evci, 23, faced Parramatta Local Court on April 6.
Evci was also charged with wounding with intent to murder, as well as indictable drug supply and dealing with the proceeds of crime and did not apply for bail.
He was arrested and charged at Burwood police station on April 5 after police raided an apartment on Hill Rd in Wentworth Point and allegedly uncovered methylamphetamine, scales and cash.
