Ramesh Mainali sentenced for glassing man at Royal Hotel, Carlton

A husband used a glass to hit another patron in the head during a confrontation over comments made to his wife inside a pub in Sydney’s south, a court has heard.

A Coles worker was “unhinged” when he used a glass to hit another man in the head during a confrontation over comments made to his wife inside a licensed hotel at Carlton, a court has heard.

Ramesh Mainali, 29, has avoided jail after he was sentenced in Sutherland Local Court on Tuesday following a plead of guilt to affray.

Agreed facts tendered to court said the Kogarah man was drinking with a group of friends and his wife at the Royal Hotel on July 5 until about 1.30am when a man with his two friends also sat in the gaming room.

Mainali’s wife told her husband the other group of men made inappropriate comments about her which caused Mainali and his friend Darsan Khadka to allegedly confront the trio before words were exchanged and a scuffle broke out.

One of the victims, Manik Karki, raised his leg and directed a push kick towards Khadka, who has pleaded not guilty to his role in the affray.

Khadka allegedly took hold of another man, Pujan KC, and pulled him to the ground before Karki allegedly grabbed Khadka and pulled him to the floor.

According to the court documents, Mainali kicked KC, who was still laying on the floor and Karki tried to stand in front of Mainali to stop his friend being assaulted.

Khadka allegedly punched KC in the chest, before he was allegedly dragged away by another patron.

At the same time, Mainali and Karki were pushing each other before Mainali turned around, picked up a drinking glass and used it to hit Karki on the left side of his head, causing a laceration and bleeding, documents said.

Police reviewed the CCTV footage and arrested Mainali and Khadka. Neither Karki nor Pujan KC were charged.

Paramedics treated Karki and KC before they were taken to hospital.

The court heard Khadka pleaded not guilty because he was acting in self defence with a hearing set down in April.

Mainali’s lawyer Elizabeth Logan said her client was working full time at Coles and at the time he was suffering significant stressors including issues with his visa, which meant his hours of work were reduced.

She said he was struggling to support his wife financially who needed surgery after a terrible car accident three years ago.

Ms Logan said Mainali had no record of alcohol-related violence in public but conceded he was convicted of choking in a domestic violence incident.

She submitted Mainali was provoked and did not instigate the fight but admitted the glassing was serious, adding if he had not been heavily intoxicated he would not have been involved.

She said the stressors in his life had since been resolved, he had reduced his drinking and was remorseful.

Magistrate Hugh Donnelly said Mainali’s actions were “unhinged” and labelled the glassing “reprehensible” and noted it could have resulted in “much more serious injuries”.

He accepted Mainali regretted his actions and took into account the stressors in his life but determined his actions were so serious it warranted a jail sentence to be served in the community.

Mainali was sentenced to a 12-month intensive correction order where he must undertake anger and alcohol counselling.
