A Rockdale man has been convicted of touching a sex worker without her consent during a service at a brothel.

Rabin Sherchan, 28, was sentenced in Sutherland Local Court on Tuesday after he pleaded guilty to sexually touching another person without consent and common assault rather than defending the allegations at a hearing.

Agreed facts tendered to court said Sherchan, who is in Australia on a tourist visa, went to a St George brothel in January last year.

He had attended multiple times, about once a month, for about a year.

Sherchan requested the “full service with diamond” experience from a sex worker which cost $150.

The pair had consensual sex, as paid for as part of the service, but Sherchan touched his penis on the woman’s anus a number of times which was not included nor did she give consent.

The woman told him to stop and said “if you do it again then I go out from the room”.

Sherchan touched the woman’s anus again and then she stopped the intercourse and showered.

Sherchan became upset when the woman attempted to leave.

The woman called out for her manager and Sherchan pushed the woman’s shoulders while she tried to leave.

The manager and the woman kept Sherchan in the room until police arrived, where he was distressed, intoxicated and crying and later told officers his penis “slipped out”.

It was agreed Sherchan’s actions were not aggressive nor did it cause the woman pain, the documents said.

In court, Magistrate Jillian Kiely was asked to consider not convicting Sherchan but she noted the woman was distressed by the assault.

“This type of an assault upon a sex worker has such a significant affect and needs to be discouraged,” she said.

“There needs to be a strong message of general deterrence for these types of offences against sex workers.”

Ms Kiely convicted Sherchan and placed him on a community corrections order where he must be of good behaviour for 12 months.
