A Sydney teen has been banned from Engadine Maccas after she got involved with a frenzied brawl which saw her boyfriend throw a stranger through a window at the fast food joint.

Magistrate Brett Thomas remarked late night incidents at Engadine Maccas had provided plenty of work for Sutherland Shire lawyers over the years – and Alina Pivoda was only the latest to partake in the unfortunate tradition of landing in strife due to a cheeseburger craving.

Pivoda, 19, was charged with common assault almost a year after she repeatedly kicked a stranger in the head after he brawled with her boyfriend in the Engadine Maccas car park.

Her solicitor Wayne Pasterfield told Sutherland Local Court the fight on October 4 last year began when the male victim allegedly made an “unsavoury comment” to Pivoda.

“The boyfriend and the victim have started fighting and they went through a window out into the car park,” Mr Pasterfield said.

Agreed police facts tendered to the court reveal Pivoda’s boyfriend “threw the victim through a glass panel” and repeatedly punched him in the head before the pair began to wrestle in the car park.

Pivoda then kicked one man separating the fight and punched the man brawling with her boyfriend twice to the head.

The Menai teen then continued to assault the victim as he lay unable to stand due to his injuries in the car park.

“The accused kicked the victim in the back three times while he was facing the other direction covering his head,” the facts state.

“The accused walked around to the victim’s head and took a four step run up before kicking the victim in the back of the head with her right foot.”

The victim was ultimately taken to St George Hospital to be treated for a fractured nose and lacerations.

Mr Thomas said Pivoda’s actions clearly reflected her significant intoxication at the time.

“McDonald’s Engadine is a huge source of work for lawyers in the Shire,” Mr Thomas said.

“It attracts numbers of young people that have been out drinking late at night and that’s when the problems arise.”

Pivoda pleaded guilty to the single charge and was sentenced to a two-year conditional release order without conviction.

She will be required to abstain from alcohol for six months and will be banned from attending Engadine Maccas for six months.

Mr Thomas issued a stern warning about the seriousness of Pivoda’s violence.

“When it comes to kicking, we used to say, when the boot goes in, you go in,” Mr Thomas said.

“That means you go to jail.”
