A disgraced pharmacist has been jailed for sexually assaulting a young woman during a consultation in Sydney’s inner south before warning her to keep quiet about the encounter.

Hany Samir Ibrahim, 47, from Matraville, was supported by his wife in the NSW District Court on Tuesday where he was sentenced for one count of sexual intercourse without consent.

Ibrahim, who has worked as a pharmacist for over 20 years, was jailed for two years with a non-parole period of nine months over the 2019 incident.

Ibrahim was working at Priceline Pharmacy in Mascot during the night of July 1, 2019 when a 19-year-old woman entered the store inquiring about contraceptive pills.

The agreed facts, read out in court, stated Ibrahim took her into a private room for a consultation and told her “I can check it out – just a quick check”.

The court heard the victim was not wearing underwear as she had raced to the pharmacy before it closed.

The court heard Ibrahim lifted up her clothing and put his finger into her vagina.

The victim was shocked and uncomfortable and eventually stood up and pulled her clothing back down.

Following the sexual assault, Ibrahim told the victim “please don’t talk to anyone” and “this is a private conversation”.

The victim began screaming before the police were contacted and attended the pharmacy.

Ibrahim was charged and pleaded not guilty to the serious offence but changed his plea to guilty last year in the NSW District Court.

Ibrahim said during his sentence on Tuesday that he was ashamed of his actions.

“I’m very regretful and ashamed of what I did. It is terrible. She was a poor girl who trusted me and I did a terrible thing,” he said.

“I don’t know why I acted unprofessionally like that. I found myself (doing) this horrible thing.”

The Crown prosecutor said the “breach of trust and vulnerability of the victim should be taken into account” and the offence warranted a jail sentence.

Judge Mark Williams labelled the matter a very sad case and said Ibrahim must have known the victim was not consenting.

He sentenced him to a jail term of two years with a reduced non-parole period of nine months after accepting special circumstances. He will be eligible for release in February 2022.

Ibrahim’s defence lawyer had earlier asked for special circumstances to be taken into account namely his challenging family environment, financial pressures which would be left with his wife while he was in prison, and his otherwise good character and record.

The court heard Ibrahim moved to Australia from Egypt in 2009 with his family.

Ibrahim’s registration as a pharmacist has been suspended by the Pharmacy Council of NSW.
