Arshdeep Bhogal: UNSW student allegedly sexually assaulted unconscious woman

A Dean’s Award-winning UNSW student is accused of sexually assaulting a woman who was passed out inside a university dorm, a court heard.

A University of NSW student has been charged with the alleged sexual assault of a woman inside a university dorm room while the alleged victim was vomiting and passed out, a court has heard.

Arshdeep Singh Bhogal, 21, a computer engineering student at the university, was arrested last month and charged with one count of sexual intercourse without consent.

A court heard on Wednesday that Bhogal was drinking tequila on the night of January 13 and he allegedly sexually assaulted a woman inside a dorm room, on the UNSW campus, later that night.

The alleged incident happened at a dorm room on campus.

A police investigation was launched after the alleged victim came forward and reported the incident.

A court has heard the woman told police she was intoxicated and passed out on a bed and woke to find Bhogal allegedly on top of her.

The court heard when she confronted him the following day to ask what had happened, he allegedly said “it happened we don’t have to talk about it” and “you puked twice once during sex and once afterwards”.

Bhogal’s defence lawyer made an application for bail last week at Waverley Local Court and said there “was an issue about consent” in the matter.

He appeared in Waverley Local Court.

Magistrate Ross Hudson refused bail and said it was a serious matter which, according to the police allegations, involved an alleged victim who was not in a state to consent nor did Bhogal allegedly ask for consent.

“She was effectively passed out,” Magistrate Hudson said.

The court heard Bhogal was a top student in his degree at UNSW and he previously received a Dean’s Award.

The court also heard he was originally from India and had moved to Australia to study.
