UPDATE

A disgraced pharmacist who raped a young woman during a consultation at a Mascot pharmacy will have to wait until later this year to learn his fate, after his lawyer suffered a serious injury and could not attend court.

Hany Ibrahim, 47, fronted the NSW District Court on Thursday to be sentenced for sexually assaulting a 19-year-old female customer in July 2019.

Ibrahim’s matter was briefly mentioned in court before his sentence date was pushed back for the second time.

The court heard Ibrahim’s lawyer had suffered a serious injury and she could not attend.

“Counsel has had an accident on February 22 which has led to four fractures of her clavicle,” a representative from her law firm said.

“Due to this she is seeking an adjournment.”

Judge Dina Yehia granted the adjournment until May 11 but said there would be no further adjournments for the sentence hearing.

Ibrahim, dressed in a blue suit and striped tie, covered his face as he left court to avoid media attention.

Ibrahim pleaded guilty to one count of sexual intercourse without consent last year.

He was working at a pharmacy on July 1, 2019 in Mascot when he sexually assaulted a 19-year-old woman.

Police said the victim attended the pharmacy for a consultation prior to the assault.

PHARMACIST GUILTY OF SEX ASSAULT

A disgraced pharmacist has pleaded guilty to sexually assaulting a young woman during a consultation at a Mascot pharmacy.

Hany Samir Ibrahim, 47, was working at a pharmacy on July 1 last year when he sexually assaulted a 19-year-old woman.

Police said the victim had attended the pharmacy in Mascot for a consultation prior to the assault.

A police investigation led to Ibrahim being charged and he pleaded not guilty in February to three offences.

However, Ibrahim changed his plea to guilty in the NSW District Court in September for the most serious charge of sexual intercourse without consent. The remaining two charges have been dropped.

He was due to be sentenced last week but his sentence date has been pushed back to March 2021.

Ibrahim’s registration as a pharmacist has been suspended by the Pharmacy Council of NSW.

Despite it being suspended last year, Ibrahim was spectacularly given permission to continue working as a pharmacist after appealing his suspension in the NSW Civil and Administrative Tribunal in late 2019.

The tribunal’s strict conditions included his not being able to interact with customers while working.

However, that decision was overturned in the NSW Supreme Court in June and his suspension was upheld.

He will be sentenced in the NSW District Court in March 2021.

Ibrahim has been a registered pharmacist in Australia since 2010 according to Australian Health Practitioner Regulation Agency (Ahpra) records.

Following his guilty plea in September, the Crown prosecutor made an application for Ibrahim to be taken into custody.

However, Judge Dina Yehia refused the application stating Ibrahim had not failed to appear previously and had not breached his bail to date.

“There is no suggestion at all that he has breached his bail or committed further offences,” she said.

“I am satisfied that bail conditions can be set that mitigate the risk.”

His bail conditions include reporting to police three times per week and not attempting to contact the victim.
