A Maroubra man arrested twice on the same night for drink driving near Bondi has been disqualified from holding a driver’s licence until 2022 after a magistrate called his behaviour “just insane”.
James McKaig, 24, from Maroubra, was sentenced at Waverley Local Court on Wednesday after pleading guilty to two charges of mid-range drink driving and drive motor vehicle while licence suspended.
The carpenter and P-plater was convicted on all three charges, fined $600, disqualified from driving until January 2020 and placed on a community correction order with supervision for 15 months.
His defence told the court he was travelling from a party near Maroubra Beach when he was first pulled over in his Toyota Hilux about 11.40pm on Saturday, July 6 on Campbell Parade, Bondi Beach.
The agreed facts stated he also had a passenger in the vehicle and was hostile with police.
He eventually failed a roadside breath test and was taken to Waverley Police Station in a caged vehicle because of his behaviour toward police.
He returned a breath analysis of 0.122 and was charged with mid-range drink driving. His provisional licence was also confiscated.
However, after leaving the station he returned to his Toyota Hilux and drove again, before being stopped a second time by police about 1.15am on O’Brien St, Bondi Beach.
He failed another breath test and was arrested and taken back to Waverley Police Station where he returned a breath analysis of 0.102.
Magistrate Paul Mulroney said the offences were very serious.
“Twice you rolled the dice with other people’s lives,” he said.
“You made two conscious decisions to drive your car knowing you were not fit to drive.
“Even after the first occasion of being stopped, that should have had an enormous impact on you but even after that you went back to your vehicle and drove again. It is just insane.”
