Police will allege Mr Timbery broke into a Nissan Navara before attacking John Nassar, 28, and Salim Nassar, 67, with a knife, after they spotted him inside their ute and tried to arrest him.

Police will allege the victims tried to hold the doors to the ute closed to prevent Mr Timbery from escaping but he managed to force his way out one of the doors.

“Timbery managed to exit the motor vehicle via the front passenger’s door at which point he was wrestled to the ground by John Nassar,” it is claimed in police facts tendered in court.

“Salim Nassar assisted John Nassar in restraining Timbery on the ground in which time Timbery used a Stanley knife to wound the right arm of John Nassar, and the face of Salim Nassar.”

The Nassar family was first alerted to Timbery when Salim saw him sitting in the front seat of their vehicle at 8.40pm with a torch.

All three men were treated for their injures, with Salim suffering the worst and having to undergo surgery early on Friday morning.

"The wound to Salim Nassar cut completely through his nose," police facts said.

Following his arrest, police searched Timbery's backpack where they allegedly found stolen goods and items commonly used in break into homes and cars.

They allegedly found four mobile phones, identification which had been reported stolen and a number of screwdrivers, drills and wrenches in his possession.

Mr Timbery’s defence argued, during his bail application, that he was assaulted prior to police arriving and arresting him.
