Walter Mumbler: Penrith man sentenced for attacking mother after stroke

A man who attacked his mother from behind while she prayed, calling her a “burden” after she recently suffered a stroke, has been sentenced.

A man, with a history of domestic violence attacked his mother while she was praying, after she had recently suffered a stroke, because he didn’t want to be her carer.

Walter Mumbler, 23, appeared at Penrith Local Court via video link after pleading guilty to common assault.

Agreed facts tendered to the court state Mumbler and his mother were living together in Penrith when the attack took place on June 27, following an argument about their living situation.

According to the court documents Mumbler followed his mother into her bedroom, where she was engaged in prayer with her back turned. He then swung at her and made contact with her right ear.

Mumbler then left the room and yelled: “Ever since you’ve had that stroke you’ve been a burden to me, I could have gotten on with my life”.

The impact of the punch caused Mumbler’s mum to suffer immediate pain and for her ear to be sore to touch.

The next morning Mumbler and his mother had another disagreement while she packed her bags and left the house before contacting police.

In Tuesday’s courtroom Magistrate Toose acknowledged there were issues within the home which “heightened” things but told him: “You don’t get to be violent in the home and make her leave”.

The court heard he had since found other accommodation and would be living separately to his mother

In her closing remarks Ms Toose advised Mumbler to “stay away from the ice and people who use drugs” and said she was pleased he would be living some where else.

In sentencing Mumbler Ms Toose took into account he had already spent a considerable amount of time in custody for other matters, so gave him a backdated jail sentence from September 9 to February 14, 2023.

Mumbler will be released on parole on an unrelated matter.
