A western Sydney pedophile has been caught with another stash of abuse material mere weeks after he was released from jail for raping a child.
James McMillan, 22, was sentenced in Penrith District Court on Monday to 18 months in jail, with a non-parole period of 12 months, after earlier pleading guilty to a charge of possessing child abuse material.
The court heard McMillan had been busted with a stash of five images and one video on September 13, 2023, only weeks after being released from prison on parole.
He had been serving time after being convicted of sexual intercourse with a person under 10 and possessing child abuse material.
Judge Craig Everson said McMillan’s latest stash, the details of which are too graphic to publish, included images of pre-pubescent girls and toddlers.
Judge Everson said the contents “could only be described as shocking” and there was “significant degree of depravity”.
He said McMillan kept the stash for his own personal gratification and the 22-year-old was attracted to children.
McMillan had cooperated with police and written a letter of apology, in which Judge Everson said he expressed remorse and demonstrated insight into his offending.
A psychologist’s report also suggested McMillan may have undiagnosed autism spectrum disorder or ADHD, but Judge Everson could not say, on the balance of probabilities, that McMillan was suffering from cognitive issues or mental ill health.
The court also heard McMillan had been studying engineering while in custody.
McMillan’s backdated sentence for his most recent crime makes him eligible for parole on December 19.
However, he is set to remain behind bars on his previous sentence until August 2025.
