Anei Dut: Former model denies allegations he possessed balaclava and house breaking instrument

A former model accused of possessing a housebreaking instrument and balaclava has denied allegations while applying for bail in court.

A former model once voted South Sudan’s third-most handsome man has denied possessing a housebreaking implement and balaclava.

Anei Dut applied for bail at Parramatta Local Court on Sunday, appearing via audio visual link and pleading not guilty to possessing a housebreaking implement and possessing means of disguising face with intent to commit an indictable offence.

Court documents reveal that police allege Dut possessed a housebreaking implement and a balaclava “between 1am and 1.50am” on Saturday at Appin. He was arrested about 1.20am and charged at Campbelltown police station.

On Sunday, the court heard Dut’s partner was present before the prosecution opposed bail as the 28-year-old’s “record [was] quite significant”.

Magistrate John McIntosh said the facts were brief, saying police allegedly found “two people in the car” as well as items.

The prosecution said by looking at Dut’s record, he was “subject to a number” of court orders.

It prompted Magistrate McIntosh who agreed, saying there was “a long list of them” and he asked whether some were “perhaps credit card fraud” which was confirmed.

The prosecutor told the court about Dut’s history of “dishonesty offences” and he pointed to a “number of breaches”.

Despite conceding the breaches were for the same offence, he said they were concerning, coupled with Dut allegedly committing these offences while serving a community correction order.

The prosecutor said there was also concern for Dut failing to appear at court and endangering the community.

Magistrate McIntosh said “there may be problems with the prosecution when it comes to the issue of possession”.

He told the court he believed there were “ample options … other than full time custody”, given there was no history of break and enter charges on his record.

When asked what bail conditions were necessary, the prosecution proposed a curfew, and travel restriction for Dut to not go within 100m of international departure, as they submitted there was a concern for the 28-year-old fleeing the country.

Magistrate McIntosh said it appeared Dut had been in the country for years, citing his first offence was several years ago.

“I would’ve thought flight wouldn’t be an issue … I wouldn’t be inclined to make that,” he said.

In discussing a curfew from 9pm to 6am, Dut said he “sometimes” works in security, requiring him to work at night, resulting in Magistrate McIntosh to ask if the condition was even necessary.

It sparked a large smile from Dut after curfew wasn’t imposed, as his lawyer John Semaan proposed a place restriction against his client entering Appin.

Mr Semaan said Dut had been complying with the conditions of his current order, and had almost completed his community service work.

He ultimately entered pleas of not guilty on Dut’s behalf and the matter was adjourned to Campbelltown Local Court on August 10 with the brief to be served by August 1.
