Trolley man escapes conviction for assaulting police officer

A man who pushed a trolley onto a busy Parramatta road in full view of police before shoving an officer — stating “I’m sick of trolleys being on the footpath” — has escaped conviction.

A man who pushed a trolley onto a busy Parramatta road in full view of police before shoving an officer — stating “I’m sick of trolleys being on the footpath” — has escaped conviction.

Jordan William Minty, 30, from Kingswood, was sentenced at Parramatta Local Court on Thursday for assault a police officer in execution of duty.

Mr Minty was walking home about 8.15pm on Friday, May 31, after drinking at the General Bourke pub in Parramatta.

The agreed facts stated police were driving along Great Western Highway when they saw Mr Minty push a trolley onto the road.

When police stopped to talk to him he said “I’m sick of trolleys being on the footpath”.

He then tried to get past one of the female officers by pushing her with both hands.

“The victim has fallen back onto the police vehicle,” the agreed facts read.

He then ran off but police caught up with him after he tripped and fell.

His defence argued in court that he had no idea he was speaking to police at the time, who confronted him wearing plain clothes and driving an unmarked police car, and he simply wanted to get past.

Magistrate Andrew Miller said it was “incredibly rare” that he would entertain not convicting someone for assaulting a police officer but he took into consideration the defence’s submission.

“I accept you were unaware that they were police,” Mr Miller said.

Mr Miller also took into consideration that Mr Minty had no previous offences of violence, his personal circumstances, and that the offence was on the lower end of objective seriousness.

He was sentenced to a conditional release order without conviction for a period of 18 months.

However, he must complete a drug and alcohol course through community corrections.
