Bronte man Jeremy Horniblow — who spat at a policeman after his drunken actions led him to be ejected from the A-League grand final — was told he should have known to control his alcohol more as a part time manager of the Clovelly Hotel.

The 24 year old pleaded guilty to not complying with a noticed direction and spitting on a policeman after he was charged under a Public Health order as part of COVID-19.

On Wednesday, Parramatta Local Court heard the former head boy at International Grammar School was removed from the Sydney FC v Melbourne decider at Bankwest Stadium for “disorderly behaviour’’ on August 30 shortly after 8pm.

When the university student began to scuffle with security when he was being removed, a Sydney FC marshall and police asked him to leave beyond 50m of the stadium and carpark because it was a licensed premises.

Court documents reveal that as Horniblow started to walk away from police he turned around and spat at Senior Sergeant Scott Simmons from the North West Region Command.

Prosecutor Rebekah Jung told the court Horniblow spat at a policeman during a sensitive time.

“This occurred obviously under the Public Health Act which were active during the COVID-19 pandemic and makes the actions of Mr Horniblow more serious than any other time,’’ she said.

Magistrate Peter Feather told the court Horniblow’s behaviour was “absolutely ridiculous” when positive coronavirus cases were still being recorded.

“You should monitor alcohol intake,’’ he said.

“You should have walked away. It’s particularly dangerous because of the COVID-19 pandemic that has swept our community and indeed the whole world. Nine hundred and eight people have died in Australia.

“It could have been transmitted to other people if you had the virus.’’

The court heard Horniblow, who is studying a bachelor of economics and Italian at university, expressed remorse and wrote to Sgt Simmons to apologise.

“You make sure this is the last time you come before the court,’’ Magistrate Feather said.

Horniblow was not convicted and sentenced to a two-year community correction order (good behaviour bond).
