A stunned motorist recorded the moments a roadside melee broke out following a car chase and crash, sparked by a daylight shooting in Sydney’s west.
The vision, which was shown to a jury during a District Court trial, shows the occupants of a Toyota Corolla and a HiLux trading punches on the side of the road in Homebush West.
Moments earlier a pursuit between both cars had come to a crashing halt, when the HiLux rear ended the Corolla hatchback leaving it a write-off at the stopped traffic lights.
Both cars were fleeing the scene of a daylight shooting in suburban Lidcombe, the jury heard, in which a balaclava clad gunman entered the HiLux ute of Gassan Haydar and threatened him.
According to Mr Haydar, he and friend Mahdi Abdelmohsen were enjoying a KFC zinger box meal when the gunman stormed the vehicle, put a pistol to his head and threatened to him.
Almost immediately after, the gunman lept from the vehicle and fired at it, before ducking into the waiting Corolla which tore away from the scene.
Mr Haydar and Mr Abdelmohsen, who were both uninjured by the shot took off after the Corolla.
During the trial, Mr Haydar said the gunman had taken him by surprise and he had pushed him from the car.
“We were eating chicken I got shocked and I pushed him out of the car,” he said
“My chicken pieces fell on the floor then we gave chase.”
The jury heard there was around five or six people involved in the brawl, three of whom police were unable to identify.
Following the two week trial, Abdul Alameddine 21, on Tuesday was found not guilty of the November 2022 shooting, with prosecutors unable to prove the identity of the gunman.
Alameddine had previously pleaded not guilty to discharging a firearm with intent to cause grievous bodily harm, firing a firearm in or near a public place, using an offensive weapon with intention to commit an indictable offence, and acquiring a pistol while subject to a firearms prohibition order, and has been acquitted of all charges.
The Crown alleged during the video Alameddine was seen being pinned down by Abdelmohsen before Haydar runs into the frame and begins punching him, the jury heard.
On Tuesday, solicitor Mostafa Daoudie said the jury’s verdict had restored his client’s faith in the justice system.
“Today’s outcome restores my client’s faith in the judicial system and the verdict confirms what we have said from the beginning,” he said
“My client is innocent and now ready to move on with his life.”
Gassan Haydar and Mahdi Abdelmohsen were charged with affray relating to the roadside brawl, and each were sentenced to intensive corrections orders of 15 and 13 months respectively in October 2023.
