Three charges against alleged sibling murderer Hussein Wraydeh, who is accused of killing his brother days after his release from prison, are to be withdrawn.
Hussein, 48, allegedly stabbed his younger brother Hassan at Guildford over a financial dispute on March 10 last year. Hassan died in hospital three days later and Wraydeh’s charge was upgraded to murder.
At Parramatta Local Court on March 13 – on the one-year anniversary of his brother’s death – two counts of causing wounding/grievous bodily harm to person with intent to murder and one count of using a prohibited weapon contrary to prohibition order were listed as “to be withdrawn”.
Hussein is still facing charges of murder and contravening a prohibition/restriction in AVO (domestic) following allegations a family feud over a car payment drove him to knife 46-year-old Hassan at the Rawson Rd home on the Sunday afternoon.
Police allege Hassan disagreed with the accused involving his mother in the financial dispute.
According to court documents, Hussein agreed but the men grew furious and began yelling before Hussein allegedly took out a 25cm flick knife from his pocket and held it at his brother’s neck for 10 seconds.
Police facts allege a man in the yard tackled Hussein into several bins but he rose again and allegedly stabbed the right side of Hassan’s neck, causing it to bleed profusely.
The facts also alleged the man attempted to disarm Hussein by tackling him to the ground and wrestled with him for up to a minute before he removed the weapon out of his hands and threw it on the roof of the backyard shed.
According to police facts, Hussein rushed to his sibling and said: “I am sorry, I am sorry. Call an ambulance.’’
Hassan was taken to Westmead Hospital where he died on March 13 after he underwent surgery and was placed in an induced coma after suffering a stroke.
He had just been released from jail on March 2 after serving a sentence with a non-parole period of five years and three months over the crash that killed his partner Georgina “Gina” Abdallah at Punchbowl in August 2016.
At court on Thursday, Hussein’s charge of causing wounding/grievous bodily harm to a person with intent to murder was adjourned for a return of a subpoena on April 3.
The other charges are due to return to court on May 1.
