Developer ordered to fix ‘serious defects’ at newly built Gladesville apartment complex

The company which built a new apartment block in Sydney’s northern suburbs has been ordered to fix a string of serious defects including leaks.

The company which build a new apartment complex in Gladesville has been ordered to fix a string of serious defects at the site including leaks causing water to enter multiple sections of the four-storey building.

Fair Trading NSW has issued a building rectification order to the developer of 11 Farm Street after an inspection uncovered nine separate issues relating to water penetrating into apartments and common areas of the building.

Records show the $3m development was approved by Ryde Council in 2016 and is currently occupied by tenants.

An inspection report released by Fair Trading last week showed the defects included water penetration into the building’s ground floor driveway, a car space, a garbage room and two sections of the building’s basement.

Water was also seen penetrating onto an upper level balcony, a common hallway and in the front entry of one of the residential apartments.

Fair Trading stated some of the leaks were “adversely impacting on the occupants” within the development.

“The absence of measures to exclude water from the (affected areas) has caused unhealthy and dangerous conditions for the residents,” the order stated.

The rectification order was issued to developer 605835194 Pty Ltd – formerly trading as Musdev Pty Ltd – on Monday and will remain in place until revoked by Fair Trading NSW.

NSW Acting Assistant Building Commissioner Stewart Scarlett has set a three month deadline for the defects to be fixed.

“I accept that the Order requires specified actions that are likely to be costly however the cost to the developer must be balanced against the benefit to the occupiers to be gained from identifying the specific building work that will eliminate the serious defects,” he said.

The development is advertised by listing agents as a “boutique group residences” that offer “contemporary” living and clean modern finishes. NewsLocal contacted the director of 605835194 Pty Ltd for comment but did not receive a response at the time of publication.
