Kylie Anne Emerson from Tuncurry in Forster court after drink driving crash on Failford Road

It took a member of the public to stop the frightening antics of a wine-fuelled Mid North Coast woman who was crashing her way toward the Pacific Highway. See what happened in court.

A Tuncurry woman who drove after downing two bottles of wine sideswiped an oncoming car before turning onto the Pacific Highway and overshooting the bend, narrowly avoiding another collision.

Kylie Anne Emerson has pleaded guilty to driving with a high range concentration of alcohol (second offence) and not giving particulars to another driver after an accident.

A third charge of refusing to submit to a breath test has been withdrawn.

Police documents submitted to Forster Local Court outlined the extreme danger posed to the public and stated that a ‘catastrophic collision’ was avoided purely by luck.

Documents state her ‘lack of remorse shown at the scene has disturbing results should this behaviour continue’.

Emerson’s criminal history includes convictions for drink driving and negligent driving while in October 2015 she was ordered to perform 100 hours of community service for using an offensive weapon with intent to commit an indictable offence.

After drinking what police later established to be two bottles of wine at her Tuncurry unit on September 21, the 51-year-old drove along Failford Rd towards the Pacific Highway.

About 500 metres from the highway she crossed to the wrong side of the road, sideswiping an oncoming car which tried to swerve out of the way.

Emerson didn’t stop, continuing to head toward the Pacific Highway.

At a left hand turn she overshot the correct lane, narrowly avoiding another collision with oncoming cars travelling 100km per hour.

A witness to the first collision had followed Emerson, and about 2km down the highway, was able to get her to pull over, according to police facts.

When officers arrived they found her in the back seat of the car well affected by alcohol.

She was unable to tell them how much she had drunk.

Emerson was unable to provide a sufficient sample for a roadside breath test and was taken to Forster Police Station where she recorded a reading of 0.258 - more than five times the legal limit.

When she appeared in Forster Local Court on Wednesday the matter was adjourned to December 13 for sentence.
