A father who threatened to “bash” a teenager working the late shift at McDonald’s when he refused to serve him in the drive-through has been slammed by a magistrate.
Roberto Barillaro, 43, fronted Picton Local Court and pleaded guilty to one count of intimidation intending to cause fear of physical harm.
Court documents stated at 12.13am on January 2, a worker was packing an order at the Gregory Hills McDonald’s when he noticed a ute arrive at the drive-through window.
The 18-year-old told Barillaro, who was behind the wheel, he would not be able to serve him and he should enter the shop to order at the counter.
Barillaro replied, “I can’t come out because of my kids”, and the worker stated,” there is nothing else I can tell you. You can come inside, or you can leave”.
After Barillaro said he would sit there, the victim closed the drive-through counter window and packed more orders.
A short time later, he heard the window open and saw Barillaro, who yelled at him, “come here, I’m gonna f--king bash ya” multiple times before saying, “come here, come outside”.
The victim urged him to calm down and said, “you have your kids with you”, before Barillaro yelled back, “imma gonna bash your head in”.
The court documents state that Barillaro tried to enter the premises through the window, and the victim ran into the dining area and informed other staff.
Barillaro left but was later charged by police officers who viewed CCTV footage. He told officers he could not remember what had been said but was apologetic and knew his actions were wrong.
At court on Wednesday, a lawyer said Barillaro, who resides in Catherine Park, was apologetic and embarrassed about what he had done.
The lawyer explained the dad had become frustrated because he did not want to leave three children in the car or get them out to go inside the store.
Magistrate David Degnan said he understood it would have been frustrating, but it did not excuse the actions.
“ You had three children in the vehicle with you, and you carried on like that to a young man ... he was only 18,” he said.
“He was a young fellow just trying to work at McDonald’s and earn some money.”
Mr Degnan also referenced how the victim tried calming him down and pointed out children were in the car, but that still did not work.
After considering the early plea, Mr Degnan convicted Barillaro and sentenced him to a 12-month community correction order. He was also fined $1000.
