A man caught out using a social media account and breaching the strict rules of a child protection order has faced court and been warned to abide by the rules.

The 36-year-old, who cannot be named due to legal reasons, fronted Picton Local Court last week and pleaded guilty to failing to comply with reporting obligations.

The Mt Annan man was convicted in 2019 and jailed for 21 months, with a non-parole period of 11 months, for sexual intercourse without consent. Charges of assault with an act of indecency and producing child abuse material were taken into account on sentence.

Court documents state he filmed the upskirt and genital areas of his young niece.

On the same day, he was also convicted and jailed for eight months for possessing child abuse material, which included a horrific stash of more than 147 graphic videos.

Court documents state since November 2020, the man has interacted with police in relation to the Child Protection Register on several occasions, including via email, annual reporting at the police station and home visits.

Then, on July 16, officers attended his home for a home visit where they viewed his computer history and found “concerning” X-rated viewing within his search history.

After reviewing his browser history and apps, it was also uncovered that he had failed to notify officers of an account on Discord, an online messaging application.

The man apologised, but according to police facts, he had been warned by police over his obligations under the Child Protection Act after he joined a gym and failed to notify them.

At his sentencing last week, the man said he was “incredibly sorry” for what he did and told the court he understood the importance of the orders that were in place.

Magistrate David Degnan noted police had reminded the man already to follow the orders and not breach them before convicting the man and fining him $1500.

“Come back again, and you won’t get anything as lenient,” he said.
