The young man charged over the fatal crash that claimed the life of a teenager is a member of the Australian Defence Force, a court has heard.

Jack McKenny, whose listed address is at Duntroon in the ACT, was charged with dangerous driving occasioning death.

He also faces a backup charge of negligent driving occasioning death.

Just after 1pm on June 11, emergency services raced to the Hume Highway at Sutton Forest after reports of a single-car crash.

A police statement said officers attached to The Hume Police District attended and were told a car veered onto the median strip before hitting a tree.

One passenger, who court documents have identified as Jack Winters, died at the scene.

Mr McKenny, 19, and another male passenger were taken to Campbelltown Hospital in a stable condition and later released.

Officers from the Crash Investigation Unit established a crime scene and examined what happened, and Mr McKenny was charged in August.

At Moss Vale Court on Monday, Magistrate Peter Thompson noted Mr McKenny was a “member of the military” and the military police were following the case.

The charges have been certified, and legal parties are set to meet and discuss the matter before it returns to court in May.

NewsLocal questioned the Australian Defence Force as to whether Mr McKenny had been stood down.

“Defence is aware that an Australian Defence Force member has appeared before the courts following a motor vehicle accident at Sutton Forest, NSW, on 11 June 2022,” a spokeswoman said.

“As the matter is currently before the courts, Defence is unable to comment.”
