Father and son Andrew Peter Daley and Peter John Daley grow more than 40 cannabis plants for personal use

A father and son duo have been sentenced after they admitted to rigging up a hydroponic set-up for more than 40 cannabis plants, just so they could enjoy a daily dose of marijuana.

A father and son duo have admitted to rigging up a hydroponic set-up for more than 40 cannabis plants, just so they could enjoy a daily dose of marijuana.

Andrew Peter Daley, 38, and his dad Peter John Daley, 63, both of Bargo, pleaded guilty in Picton Local Court on Tuesday to cultivating a prohibited plant by converting to bedroom into a cannabis den, with the hydroponic set-up complete with heat lamps, exhaust filters, tower fans and an irrigation system.

A ‘grow diary’ was even used to track the progress of each plant as part of their personal operation.

In November, a search warrant was executed on their four-bedroom home where the two pot smokers were “honest, cooperative and straightforward” with police, the agreed facts stated.

The pair told authorities how they watered, gave nutrients to and harvested the cannabis plants in a converted bedroom, known as a ‘grow room’.

A number of bags and boxes of cannabis leaf, with a combined weight of 4.8kg, was found in the room however the court heard it was five years worth of wastage which hadn’t been thrown out due to “laziness”. A dozen containers of cannabis seeds was also found in the younger Andrew Daley’s bedroom.

“There is nothing to suggest this was part of any sophisticated criminal enterprise,” their lawyer said. “The cultivation was for personal use, rather than for profit.”

The court heard Peter Daley had been using cannabis for four decades but was a light user, smoking two to three times a day. Father-of-one Andrew Daley’s cannabis addiction had intensified in recent years after he was widowed.

Magistrate Ian Cheetham convicted the pair and placed them both on an 18-month Community Corrections Order.
