Bradcorp, the developer behind a massive 5000-home project in Sydney’s southwest, is on the hunt for a new delivery partner after it recently suffered a major setback in the NSW Supreme Court.
Chinese-backed Country Garden, now known as Risland, escaped a contract to buy 870ha in Wilton New Town after the court ruled Bradcorp hadn’t kept its side of the bargain.
Bradcorp chief executive Peter Brennan vowed to appeal the Supreme Court decision.
“We have reviewed the judgment, however believe we have met our obligations and as such, will absolutely appeal the decision,” he said.
“The judgment is based on legal technicalities and in no way impacts our vision for the project and its delivery for the people of Wollondilly.”
The 870ha site, which was rezoned by the NSW Government in late 2018, was set to include a school, sporting fields, 11ha man-made lake and become home to about 15,000 people.
An option agreement for the Bradcorp-owned site was signed between the developers in 2017 with Country Garden contractually bound to buy the land if certain conditions were met.
When Bradcorp triggered Country Garden’s purchase of the site last year, the foreign-backed developer claimed three conditions hadn’t been met and disputed the validity of the contract. Bradcorp launched NSW Supreme Court proceedings last December.
The court ultimately ruled in favour of Country Garden but noted only one condition, relating to site access from the Hume Highway, hadn’t been met.
Mr Brennan said the company was ready to move forward with the project.
“The Bradcorp team is finalising applications for the first stage of North Wilton,” he said.
“Bradcorp has a long history of pursuing the best outcomes for Macarthur and will continue to do so. We are part of this community and our contribution over many years speaks for itself.
“We are committed to working with a delivery partner that has both the capability, commitment and experience to deliver something extraordinary for the people of Wollondilly.”
