Billikin Way seige: Elyas Dargin spared jail for Ambarvale siege

The man that led police on a high-speed pursuit, before bringing an Ambervale street to a standstill told the magistrate he ‘was on a drug binge at the time’ during sentencing.

A 21-year-old has narrowly avoided a prison sentence after admitting to leading police on a pursuit in a stolen car, before holing himself up in an Ambervale home, sparking a four-hour siege.

Riot police were called in to assist during the standoff on August 18, when Elyas Dargin was eventually arrested and charged with eight offences.

The major operation began when police spotted the 21-year-old behind the wheel of a stolen SUV in Airds.

Dargin sped away from police, before the pursuit was called-off for safety reasons at Appin Road.

The stolen car was later spotted outside a home in Billikin Way, Ambarvale.

Riot police officers were called in to help defuse the situation when Dargin refused to leave the home.

Then at 2pm, he left the home alongside a 16-year-old boy.

The 21-year-old told the court he’d been ‘on a drug binge at the time’ and was later hospitalised after his arrest.

The court heard Dargin had been in and out of foster care as a child, and had starting using marijuana at 13, before progressing into heavier drugs.

Magistrate Shane McAnulty adopted a special power within NSW Courts during sentencing called a Section 58.

Instead of a full custodial sentence, Dargin was placed on an Intensive Corrections Order for three years.

Further conditions, will mean Dargin has to adhere to a curfew between 6pm and 6am, and abstain from drinking alcohol or using drugs for the next two and a half years.

Magistrate McNulty warned ‘if you have no offences in that time you will be free from jail, but failure to comply you could face up to 5 years behind bars.’
