A father threatened to kill a man in an turbulent outburst after a late night out drinking with friends.

An unemployed father threatened to kill a man in an explosive midnight tirade after a boozy night out drinking with friends, a court has heard.

Thuy Ngoc Bui, 51, pleaded guilty to stalking, intimidation and assault at Liverpool Local Court on Tuesday following an incident at his Hinchinbrook home between 1.30am and 2am on April 24.

In documents tendered to court, Bui returned home intoxicated and caused a witness to wake up and argue in the lounge room.

The victim placed himself in between Bui and the other person to stop them arguing.

“Bui became angry at the victim’s interference and spoke to witness three and said words to the effect of: ‘either he kills me or I kill him’ while gesturing in the direction of the victim,” the facts state.

The victim asked “are you threatening me” before Bui attempted to headbutt them.

The facts state the victim dodged the strike and grabbed Bui by the arms before pushing him away.

A second person woke up and helped the victim physically escort Bui back to his bedroom, but he returned to the lounge room and continued to insult the victim and other people in the house.

The victim told police that Bui appeared intoxicated during the incident and “smelled strongly of alcohol, was unsteady on his feet and his eyes were wide and unfocused.”

Bui called triple-0 after the two witnesses and victim left the home.

According to police facts, Bui told officers the victim and witness two had both pushed him during an argument but his version of events were “inconsistent and he continuously changed his story.”

After speaking with the victim and witness one who both gave officers similar versions of events, police arrested Bui and took him to Liverpool police station.

Magistrate Iman Imad Abdul-Karim said while he accepts “words are hollow words when drunk” but Bui’s actions were inexcusable.

“I accept it’s at the lower end of scale but the incident occurred at a time when you were drunk and the victims were asleep and you woke them up,” he said.

Bui was convicted and sentenced to a conditional release order for 12 months.
