A DOMESTIC violence dispute where a woman was allegedly punched in the face in front of her infant son has become a bizarre case of she said, he said, she said.

A man, 22, has spent three weeks in Bathurst Correctional Centre after he was accused of allegedly breaking into his estranged ex-partner’s Merrylands unit and punching her in the eye in front of their 13-month-old son.

A magistrate at Fairfield Local Court today released him on bail because his ex-partner now alleges she was assaulted by someone she believed to be his new girlfriend.

In an affidavit provided to the court the victim said her previous statement alleging the man attempted to kick down her door, causing substantial damage to the deadlock before confining her to her bedroom and striking her in the right eye with a closed fist was false.

“(He) did not do anything to me,” she wrote.

“When the police came I told them it was (him) because I thought it was his girl and I was angry.”

The man was ordered to report daily to Mt Druitt police station.

The magistrate granted bail due to the witness’ second statement and the prosecution’s concession that several calls made to police by the victim during the alleged incident could not confirm the victim’s attacker was a male or a female.

The woman the victim has accused has not been charged or identified.

The victim did not appear in court today, saying she had to take her son to a hospital appointment.

The victim and the man were in a relationship for two years and he had already been prevented from contacting or associating with her due to a previous apprehended violence order served against him.

His mother, aunt and current de facto wife wept and prayed as they watched him on the audiovisual link from the Bathurst prison.

The man’s family paid $1000 bail for his’s release, and he will also be required to reside with his de facto in Mt Druitt and report to local police every day until his next appearance at Parramatta Local Court on July 10.

The man, an Australian citizen who immigrated from Sierra Leone and allegedly attended high school in the Liverpool region, was also forbidden from applying for a passport or leaving the country.
