Liverpool: David Devoe charged with sexual offences on trains

A young man who allegedly exposed his genitals to a woman on a Sydney train and performed an act of indecency in front of another has been released into the community, but only allowed out with his mum.

A man accused of “disturbing and predatory” behaviour on Sydney trains has been released on bail.

Police have charged David Devoe, of Guildford, with a series of offences, beginning last December, when he is alleged to have performed an act of indecency in front of a 35-year-old woman on a train travelling between Cabramatta and Liverpool.

The second incident is alleged to have taken place on March 27, with police claiming the 24-year-old exposed himself to a 23-year-old woman on a train at Liverpool train station.

In a third incident on April 19, police allege Mr Devoe spat inside a train carriage as it travelled between Liverpool and Cabramatta, and verbally and physically intimidated a 31-year-old woman.

He handed himself in to Fairfield Police Station on Wednesday and was charged with two counts of carry out sexual act with another without consent, stalk/intimidate intend fear physical etc harm (personal), behave offensive manner in/on public passenger vehicle etc, travel or attempt travel without valid ticket – adult, and spit in or on public passenger vehicle, train or public area.

Pleas have not yet been entered for the charges.

On Thursday, Mr Devoe’s solicitor applied for his release on bail, which was opposed by the prosecution.

The police prosecutor said it was a strong Crown case and there was CCTV footage of Mr Devoe’s alleged “disturbing and predatory behaviour”.

Magistrate Miranda Moody said police allegations he exposed his penis would have been “frightening” for passengers.

However, she granted him bail with strict conditions akin to house arrest, with Mr Devoe allowed to leave his home only in the presence of his mother.

Addressing him on video link, Ms Moody said: “I was very reluctant to grant you bail. If you have behaved in this way, it’s extremely frightening and distressing for ordinary passengers to deal with.”

The matter was adjourned to next month.
