Dinesh Bishwakarma filmed himself sexually touching ‘blacked out’ woman on Burwood Rd

An inner west man took advantage of a drunk, unconscious woman by carrying her to a “secluded” location and filming himself groping her, a court heard.

A Burwood man carried an unconscious woman to a “secluded” location and filmed himself groping her.

Dinesh Bishwakarma faced Downing Centre District Court on Thursday from custody after he pleaded guilty to two counts of sexually touching another person without consent and one count of intentionally recording intimate images without consent.

Court documents state the intoxicated 24-year-old was captured on CCTV footage walking along Burwood Rd where he found a ‘blacked out’ woman sleeping on a bench about 3.45am on January 25 last year.

The 30-year-old woman had visited Strathfield Hotel where she had consumed up to 10 glasses of wine, police facts continue.

He lifted the victim’s shirt up and began filming himself touching her exposed breasts. The woman flinched and Bishwakarma said: “Can you see me?”

She remained unconscious and Bishwakarma began recording again.

Bishwakarma pulled her pants down and rubbed his exposed genitalia on hers before leaning over her and thrusting himself towards the woman up to four times.

A council street sweeper approached Bishwakarma and asked what he was doing.

He pretended the victim was his girlfriend and pulled up his pants.

“Babe, babe. Wake up,” Bishwakarma said.

He ran away while a Burwood Hotel security guard, who had witnessed the incident, dialled triple-0.

Officers arrested Bishwakarma and took him to Burwood Police Station where he told police he knew the victim was drunk and had not consented.

Bishwakarma said he made a “big mistake” and claimed he did not know he was groping her in public.

The victim was woken up by police and was “startled” to find herself exposed. She was unable to recall how she ended up outside the bank.

She was taken to Royal Prince Alfred Hospital.

During his appearance in court, Bishwakarma’s barrister Anthony Strik argued his client did not have sexual intercourse with the woman and no threats or violence were involved.

“No one watched the videos, which last up to 35 seconds each,” he said.

Mr Strik said Bishwakarma did not wear protection while offending but the incident did not result in the woman contracting a sexually transmitted infection (STI).

He had been in custody for 12 months and had no prior criminal record, Mr Strik added.

The crown prosecutor argued there was no evidence to support the woman had not received an STI.

Ms Cooper said Bishwakarma had not served enough time in jail for the crimes and the community would expect him to receive a longer sentence to prevent him from committing further offences.

Judge Robert Sutherland said the victim was sexually touched in a public place while unconscious and semi-naked.

He adjourned the judgment to later this month and Bishwakarma remains bail refused.
