An Instagram influencer and OnlyFans creator was in tears after she was refused bail for allegedly assaulting her former boyfriend the day he returned from an overseas holiday.
Matilda Marshall, 33, sought release in Wollongong Local Court on Thursday after she was charged with assault occasioning actual bodily harm, contravening an apprehended violence order and breaching bail conditions.
The court heard Marshall was already on bail related to similar charges against her former boyfriend that allegedly occurred while they lived in the Katoomba area last year.
She admitted to breaching the residence and no-contact conditions.
The court heard Marshall no longer wanted to live at an address she was bailed to in Corrimal because she felt uncomfortable there, so she was staying at her Wollongong home that she rented, and was still on the lease, with her former boyfriend while he was on holiday for two weeks.
The court heard Marshall’s former partner arrived home on Wednesday but she had not left yet, despite her being prohibited from contacting him.
The couple allegedly got into an argument that included yelling and swearing for several hours before Marshall allegedly scratched her former boyfriend on the check.
Defence lawyer Emel Ozer submitted Marshall said she was acting in self defence at the time and was trying to allegedly prevent her former boyfriend from assaulting her, which Marshall later told police once arrested.
The court heard Marshall had no convictions on her criminal record but was facing a number of domestic violence charges including assault, destroying property and contravening AVOs which remained before the court.
Ms Ozer said Marshall therefore may not be sentenced to full-time custody if convicted of the allegations on Wednesday, noting the alleged assault appeared “minor”.
Ms Ozer said Marshall had nowhere else to live and would need to go into emergency housing, adding she had previously been in contact with Wollongong domestic violence and housing services.
The court heard Marshall was on medication for mental health issues, was regularly seeing psychologists and was completing a nine-month course to help treat her borderline personality disorder.
Ms Ozer said Marshall would therefore be vulnerable in custody if she was refused bail, also noting she had never been on remand before.
Police prosecutor Sergeant Amelia Wall said Marshall’s other charges indicated the same man had allegedly been assaulted multiple times, and therefore there were concerns for his welfare.
Sgt Wall said Marshall could face full-time custody given she allegedly contravened an AVO order with violence.
The prosecutor also said there was a risk Marshall would fail to appear in court because she travelled for her “influencer work” and had previously lived in Queensland.
However, Ms Ozer said her client was not close with her family and did not have ties in Queensland or NSW, adding Marshall and her boyfriend moved together from Queensland to the Katoomba area before living in Wollongong.
Registrar Tina McKenna took into account Marshall had no convictions, but found she had not complied with the residence or non-contact conditions of her bail and AVO.
Marshall was refused bail, prompting her to put her head in her hands and cry.
The case was adjourned to January 9.
