A tatted-up concreter has learned his fate after he was caught with ecstasy pills, diazepam and meth hidden in his car after an ill-fated trip to Bunnings.

Rory James Smith, the owner of concreting company Bosscrete, faced Nowra Local Court on Monday for sentencing after earlier pleading guilty to shoplifting, two counts of drive motor vehicle during disqualification period, possess/attempt to prescribed restricted substance, possess prohibited drug and drug supply, custody of a knife in a public place and using a phone while driving.

According to court documents, Smith’s string of offences began on January 22 last year when he was busted shoplifting items to the value of $646 from Bunnings Warehouse in Kembla Grange.

Documents reveal Bunnings staff saw Smith steal the items and approached him as he was attempting to leave the carpark and called police.

Officers discovered he had been driving while disqualified, court documents stated. His disqualification had only kicked in a few weeks prior.

Smith was asked if he had any stolen items in the vehicle to which he acknowledged, and was asked to retrieve the goods from his car.

A black safe-like box was also located on the front footwell of the front passenger seat.

Police searched the small black box and found 16 ecstasy pills, 1 gram of meth, 10 diazepam tablets as well as other prescription medications.

According to court documents, Smith was also pulled over in a grey Ford Ranger by unmarked police on Market St in Wollongong, on the night of March 13.

The two officers knew of Smith’s disqualification and arrested him before they found a 20cm camouflage pocket knife in his back pocket.

Asked if he was in possession of drugs, he allegedly pointed the police towards a bag of “ice” in the front passenger seat where five and a half white and blue pills Smith claimed to be “immunity boosters” were located.

Police also allegedly located 1.62 grams of cocaine which Smith claimed to be “Xanax and valium”.

Smith returned a positive roadside drug test.

Court documents stated Smith’s third run-in came on the afternoon of September 15 on Bong Bong Rd in Dapto when police observed him driving a Mitsubishi Canter while using a mobile phone.

On Monday, Magistrate Lisa Viney acknowledged Smith had been “self-medicating” in an attempt to manage mental health issues.

She also cited Smith moving from Wollongong to North Nowra in order to “get away from bad influences”, however, she declared there needed “to be a deterrence” for his actions.

He was sentenced to a 12-month corrections order, $1350 in fines and will be required to complete 100 hours of community service.

The 30-year-old’s driving suspension will continue for eight months from January 24 and he must continue participating in a drug rehabilitation program.

Smith was fined $500 for shoplifting, $500 for being in possession of a knife and $350 for using a mobile phone while driving.

Smith will be back in Nowra Local Court on February 21 for further sentencing.
