CCTV footage will form part of the police evidence against a maths tutor accused of sexually touching a teenage student during a lesson in Sydney’s northwest.
Tai Hoon Lee, 51, was arrested last August and charged with two charges of sexually touching a person without consent – the second being an aggravated charge as he was her tutor.
The first charge has since been dropped and Lee is now facing the one aggravated sexual touching charge.
Lee, who has pleaded not guilty, faced Parramatta Court for the first day of his hearing on Wednesday where he was assisted with a Korean interpreter.
Lee, from Castle Hill, is accused of touching the 16-year-old girl during a private tutoring lesson after 5pm on August 20.
He is also the owner of Castle Hill tutoring centre, Smart College, where the alleged offence took place.
In court, DPP prosecutor Nathan Johnston said Lee was alleged to have sexually touched the student during the after-school maths lesson.
“The tutoring session commenced and at some time the accused allegedly touched her on the breast,” Mr Johnston told the court.
Yet Lee’s lawyer Mario Licha argued that Lee did perform a “flicking motion” with his hand but denied touching the student.
The complainant gave her testimony via AVL screen and was cross-examined for more than three hours in closed court.
Lee’s defence also attempted to make an application for a non-publication order to prevent media from reporting Lee’s name and tutoring company but it was rejected by the magistrate.
Lee, who is on bail, will return to court in August for day two of his hearing where CCTV footage taken just after the alleged incident will be shown.
Two witnesses will also take the stand including the complainant’s mother and the police officer in charge.
