A night out at Glenorie RSL went horribly wrong for a luxury car driver after he was caught drink driving — more than four times above the legal blood alcohol limit — with two children and their nanny in the back of the car.
Glenorie man Shelvin Singh, 37, faced Hornsby Local Court after being charged with high-range drink driving.
These charges spring from a night out in May, when emergency services responded to reports of a BMW M5 crashing into three parked vehicles on Post Office Rd, Glenorie.
When officers from Traffic and Highway Patrol Command arrived at the scene, they noticed three passengers — including two children, aged three and eight — in the back seat of the car.
In court, Magistrate Rami Attia denied the defence’s request to have the charge dismissed on mental health grounds.
The court heard Singh was diagnosed with bipolar, had a history of major depressive episodes and suffered from alcohol use disorder.
But Mr Attia said he could not dismiss the charge because of the seriousness of the offence, one where “alcohol misuse is at the very heart of this offending”.
Mr Attia also said Singh had a similar offence — for high-range drink driving — on his record but no conviction was recorded for this previous matter.
Reading from the police facts and Singh’s testimony to police, Mr Attia said at the time of the crash Singh told police he did not realise how drunk he was and was quoted as saying “I didn’t feel intoxicated”.
But when Singh drove away from the Glenorie RSL, with the family nanny and two children in the back of the BMW, he first veered to the left and collided into the back of an unattended car, the court heard.
As Singh continued onto Post Office Rd, Glenorie, he accelerated and the car’s engine was heard revving loudly.
Soon Singh crashed into another car which was parked next to a gutter. Inside the parked car was a man who received medical attention at the scene but was not seriously injured.
The front right hand window of the car flew some 20m down the street as a result of the collision and led to the parked car ramming into the back of another vehicle.
The court heard Singh was “belligerent” toward emergency services when they arrived at the scene and began yelling words to the effect of “I was not driving”.
He is also alleged to have told police he only consumed one glass of wine — despite later returning a breath analysis reading of 0.224 at Castle Hill Police Station.
“This is a serious offence,” Mr Attia said. “(It) placed quite a number of people at significant risk including … members of the public who were going about their business.”
As the request to dismiss the charges on mental health grounds was denied, Singh will return to court for sentencing in December.
