A man charged over the murder of Tuan Vo Tran, whose body was found in the backyard of a Mt Pritchard home, has been refused bail.

Adam Asad, of Cabramatta, appeared at Liverpool Local Court before Magistrate Miranda Moody charged with murder and aggravated break and enter (commit serious indictable offence).

Homicide Squad detectives arrested the 39-year-old at a Cabramatta home on Wednesday following extensive investigations.

Emergency services were called to a home on Young St, Mt Pritchard, about 7.50am on October 30, 2019 after reports of a disturbance earlier that morning.

Mr Tran’s body was found in the backyard of the home and while a post mortem examination was inconclusive, police said he suffered head injuries and lacerations.

Police allege Mr Asad was the driver of a Honda CRV seen arriving at and leaving the Mt Pritchard home at the time of the incident.

His solicitor Upol Amin today said his client intended to defend the charges in court, however, pleas have yet to be formally entered.

“Your Honour, it is conceded it is a serious offence. No one is shying away from that fact,” Mr Amin said.

However, he said the prosecution case was “extremely weak” and there was “not a single piece” of direct or indirect evidence in the police fact sheet connecting his client to the alleged murder.

He said the only factor linking Mr Asad to the vehicle was that he “may have purchased it some time ago”.

Mr Amin said his client’s matter may experience a longer delay than usual due to the COVID-19 pandemic.

The court heard Mr Asad suffered from chronic back and mental health issues after being tortured over eight months in Iran — from which he fled as a refugee 20 years ago — and required medication.

The police prosecutor opposed bail, arguing it was not a weak case.

He told the court a statement had been made by an alleged co-offender, now deceased, linking Mr Asad to the alleged incident.

Ms Moody refused bail and the matter was adjourned to July 20.

“Were Mr Asad to be convicted of the offences before the court it is inevitable that a lengthy prison sentence would follow,” she said.

“I don’t agree that it is a weak case.”
