Shayne Towney, 47: Dubbo man sentenced for common assault of ex partner

A drunk man who shoved his ex-partner on the chest over his suspicions that she had been cheating on him has been convicted in court.
Shayne Towney has appeared in Dubbo Local Court pleading guilty to a domestic violence related common assault charge and destroying or damaging property after a night of drinking with his ex partner.
The 47-year-old initially denied allegations to the police, however entered a guilty plea in court on Thursday.
The incident occurred between 11.35pm and 11.45pm in June 2022 after Towney “shoved” his ex-partner on her chest.
Agreed facts tendered to the court revealed Towney and his ex-partner were in an intimate relationship for three months prior to the incident, however the relationship had been “tumultuous” and “volatile” from the beginning.
On June 8 2022, documents state Towney and the victim were drinking together at the victim’s home when she decided to go to bed.
According to the facts, the victim did not want to share a bed with Towney and they got into an argument.
Towney became “jealous” and yelled at the victim about her cheating then pushed her on the chest with both hands.
The victim asked him to leave however he refused.
Towney grabbed her phone which was sitting on her bed and threw it on the front steps of her house.
The victim tried to throw a bottle of alcohol at Towney’s car but missed.
She then grabbed a nearby shovel and hit Towney’s windshield causing “significant damage”.
According to the facts, Towney told the victim he wanted to grab his keys and leave, however continued to argue with the victim and refused to leave.
This led to the victim becoming further “agitated” and starting to “punch” the defendant multiple times in the face.
Towney’s solicitor Fiona Alamyar stated her client suffered “bruising, a black eye, swelling and a split lip” as a result of the victim’s reaction.
“He has not spoken to her since the day of the incident,” Ms Alamyar said.
“He has no desire to reunite with the victim.”
Ms Alamyar told the court Towney is in the process of “applying for rehabilitation” and is “promised employment”.
Magistrate Gary Wilson convicted Towney to a Community Corrections Order for 12 months.
