Marcia Dixon: Dubbo woman charged over road rage gets bail

Doctors have refused to hand over details about injuries a woman sustained after she was left in a critical condition because of random road rage, a court has heard.

A Dubbo woman accused of leaving another woman with serious injuries after a shocking case of road rage was caught on camera has been granted bail nine months after she was first charged.

Police allege Marcia Ann Dixon, 43, drove a Holden Commodore into a woman after a verbal altercation on the side of road near the intersection of Cobra Street and Brigalow Avenue in Dubbo on September 3 last year.

The 41-year-old woman Ms Dixon allegedly drove at had to be flown to Westmead Hospital for treatment.

Ms Dixon was initially charged with cause grievous bodily harm to a person with intent and fail to stop and assist after vehicle impact caused grievous bodily harm.

No pleas were entered and Ms Dixon was refused bail in Dubbo Local Court on September 4.

She has been remanded in custody ever since, however in court on June 10 defence lawyer Bill Dickens said Ms Dixon’s circumstances had changed and a new bail application should be made.

Mr Dickens said the offences police initially charged Ms Dickens with were so serious one carried a maximum sentence of 25 years in jail.

He told the court police had this year charged Ms Dickens with two new less serious offences — negligent driving causing grievous bodily harm and recklessly causing grievous bodily harm.

“The issue is there’s an acceptance that whatever is to proceed doesn’t involve intent to cause grievous bodily harm,” Mr Dickens said.

“She’s now served nine months and it is well conceivable that she would not be required on sentence to serve further time in jail.”

Mr Dickens told the court of the new offences Ms Dixon had been charged with, the most serious carried a maximum term of imprisonment of 10 years.

He said Ms Dixon had not entered pleas to any charges because doctors had not been forthcoming with information about the nature of the injuries Ms Dixon’s alleged victim had sustained.

The court heard the injuries may have been less serious than first thought and the more serious charges police had laid against Ms Dixon were expected to be withdrawn.

“I understand the doctors haven’t been cooperative … Ms Dixon shouldn’t be required to stay in jail endlessly for that reason,” Mr Dickens told the court.

“She is a person of little record. Immediately after, she drove to the police station to report what happened.

“She’s becoming increasingly depressed.”

“There’s little doubt about what happened because most of it was recorded by the occupants of the other two cars on mobile phones.”

After Magistrate Gary Wilson allowed the new bail application to be made and listened to Mr Dickens’s submissions, prosecutor John Doohn said he was concerned if Ms Dixon got bail she would fail to front court.

“A number of warrants have had to be issued over the years,” he said.

Magistrate Gary Wilson said he would grant Ms Dixon bail, however she must not drive a motor vehicle and has to report to Dubbo Police Station every Monday, Wednesday and Friday.

Ms Dixon wept after Magistrate Wilson announced his decision and adjourned her case to a date in July.
