Dr Khin Thet: Parkes doctor rape trial jury discharged

The jury in the trial of a Parkes GP accused of sexually assaulting two women he treated in 2013 and 2018 has been discharged after a woman became “hysterical”.

The jury in the trial of a Parkes doctor charged with raping two patients has been discharged after one day because of an incident which occurred during the jury selection process.

Dr Khin Thet, 65, has pleaded not guilty to four aggravated sexual intercourse without consent charges and his trial will resume on Monday with a new jury.

Two women have alleged they were raped by Dr Thet during two consultations in 2013 and 2018.

An initial jury to determine his fate was chosen on Wednesday and Dr Thet’s trial began with an opening address from Crown prosecutor Mark Davies.

On Thursday morning, Dubbo District Court Judge Nanette Williams said the jury had to be discharged after a potential juror became “hysterical” during the empanelment process.

“I am deeply troubled by the emotional demonstration which occurred,” Judge Williams said.

“Clearly from my observations … it would have affected the whole entirety of the panel (of potential jurors).

“I’ve never seen such a highly charged and dramatic incident in front of a panel.”

The Crown initially objected to Judge Williams’s decision to discharge the jury, however after she made it clear her decision was final both sides in the case issued no objection.

“This is my courtroom and I’ve formed a view that what happened yesterday formed a potential unfairness,” Judge Williams said.

“It is my job to ensure the accused has a fair trial according to law.”

Dr Thet was supported by his wife in court and took notes during the day’s proceedings.
