Anthony Wopenka: Dubbo man sentenced for assaulting woman during sex, sharing intimate pics

A magistrate has slammed a disability worker for his ‘perverted conduct’ which involved assaulting a woman during a group sex encounter and sharing images of her having sex without her consent.

A Dubbo man who repeatedly slapped a woman during a group sex encounter and shared pictures of her having sex with another man has been sentenced to a 12-month term of imprisonment.

Anthony Wopenka, 23, and another man had only recently arrived at the woman’s home for a threesome earlier this year when things quickly turned nasty.

According to court documents, Wopenka slapped the woman’s face while he was having sex with her and she said “don’t do that”.

In response Wopenka said “you like it when I treat you like a whore” and he slapped the woman again.

After he finished having sex with the woman Wopenka watched as she had sex with the other man in attendance.

The woman saw a camera flash, however when she confronted Wopenka about it he denied any wrongdoing.

Following the group sex encounter Wopenka shared a photograph of the woman in a group chat to brag about how he had his first threesome.

Members of the public told the woman they’d seen a video of her having sex and in June she reported it to police after Wopenka again denied wrongdoing.

In court documents police said Wopenka worked for disability service provider Westhaven and “given the nature of this offence police hold grave concerns for the welfare of these vulnerable residents as they are non-verbal and high dependent”.

Wopenka was convicted of common assault and two counts of intentionally recording and distributing intimate images without the woman’s consent last month.

In court for sentencing on Wednesday Wopenka’s lawyer Jai Silkman said his client had recently been through a break-up when the assault and intimate image offences happened.

Mr Silkman told the court Wopenka had sought access to counselling through his employer.

“It was shared with a closed group as opposed to being shared openly,” Mr Silkman said of the material Wopenka distributed.

“He doesn’t know whether he will lose his job over this.”

Magistrate Philip Stewart said Wopenka caused the woman to suffer from “gross humiliation” and ongoing suffering because the images he shared were now in the public domain.

“How do you retrieve that material once it’s out there?,” magistrate Stewart asked.

“The conduct is perverted … deviant behaviour, it is absolutely shameful.”

After taking into account Wopenka’s lack of a criminal history and accepting his contrition, magistrate Stewart sentenced him to a 12-month intensive corrections order, which is a term of imprisonment that can be served in the community.

Wopenka was placed on a community corrections order for 12 months for assaulting the woman.

“Do not carry on like this again with another human being,” magistrate Stewart said.

“If you don’t understand how relationships work don’t enter them”.
