Anthony Wopenka convicted of intimate image offences

A disability worker convicted of assaulting a woman during a threesome and sharing intimate images — distributed around Dubbo — without her consent, now has a chance to clear his name.

A 23-year-old Dubbo man who never showed up for court and was convicted of intentionally recording and distributing intimate images of a woman without her consent has been urged to get legal representation.

After a photo and video of the woman engaged in a sex act with another man was distributed to people in Dubbo, police charged Anthony Wopenka with the intimate image offences and another count of common assault.

Wopenka failed to front Dubbo Local Court on October 14 and in his absence Magistrate Philip Stewart convicted him of all offences.

A warrant was put out for Wopenka’s arrest and on Wednesday he represented himself in court.

Magistrate Gary Wilson told Wopenka the crimes he’d been convicted of were serious and strongly advised he get legal representation about whether or not to pursue his right to annul the convictions and enter pleas of not guilty.

In court documents, police said Wopenka and another man went to the woman’s Dubbo home to have a threesome earlier this year.

The woman consented and when Wopenka slapped her face while they were having sex she said “don’t do that”.

According to police, Wopenka said “you like it when I treat you like a whore” and he slapped the woman’s face again.

She grabbed his hand and said “don’t slap me in the face” before the sex act ended.

Wopenka remained in the room and while the woman was having sex with another man she saw a camera flash.

Afterwards, police said Wopenka posted a photograph of the woman in a group chat to highlight how he had his first “three way”.

The woman asked Wopenka to delete the photo and he said he would.

However, in June the woman was approached by multiple people who told her they’d seen a video of her having sex.

The woman spoke to Wopenka about it twice and he denied having or sending a video of her.

On July 31, police interviewed Wopenka and in court documents, officers said he made full and frank admissions to the offending.

Police said Wopenka worked for disability service provider Westhaven and that “given the nature of this offence, police hold grave concerns for the welfare of these vulnerable residents as they are non-verbal and high dependent”.

Wopenka is due to return to court in November.
