A man has pleaded guilty to filming someone in a private act after using his mobile phone to spy on a teenage boy taking a leak at a busy cinema.
Gavin Barrett, of Toukley, faced Wyong Local Court on Tuesday where he pleaded guilty to one count of filming a 14-year-old boy urinating on March 31.
An agreed set of facts states the boy and his grandmother had gone to see a film when he needed to use the bathroom about 7.20pm.
He walked out of the movie and was captured on CCTV walking towards the public toilets.
About the same time CCTV captured Barrett leaving the men’s toilets.
“As the victim approached the entry of the bathroom, the offender turned around and walked back inside the bathroom,” the facts state.
The victim went into a toilet cubicle, locked the door and pulled down his pants to urinate. A few seconds later the offender entered the cubicle next-door.
“While doing this the victim observed a mobile phone to appear from under the bottom of the cubicle.,” the facts state.
“The victim called out ‘What are you doing, what are you doing?’, however the offender did not reply.”
After he was finished the victim exited the cubicle and saw the door next to him was unlocked so he knocked on the door which opened.
He saw the offender was fully clothed, holding his phone and sitting on the toilet.
“The offender said ‘I’m taking a shit right now’. Noticing that the offender still had his pants on, the victim walked out,” the facts state.
He reported it to staff and his grandmother, who confronted Barrett when he came out of the bathroom but he denied the allegations.
Staff informed him police had been called but Barrett refused to wait and walked to his car and drove away.
Police reviewed the CCTV and got Barrett’s car rego plates, which led them to his house.
He agreed to be interviewed and confirmed he was the registered owner of the car but exercised his right to remain silent about anything else.
After pleading guilty his bail was continued and he was ordered to undergo a sentence assessment report before he returns to court on January 15.
