Simon Monteiro: Hearing date set as man dubbed the ‘Playboy Rapist’ appeals intimidation conviction

The man dubbed the "Playboy Rapist" Simon Monteiro is fighting intimidate/stalk charges against his brother on the NSW Central Coast, with a hearing date now set.

A court will hear why a “potential psychopath” dubbed the ‘Playboy Rapist’ believes he should be released from prison.

Simon Monteiro was convicted of intimidation on November 23 last year, after making threats against his brother Brett Lowe in a dispute over the family’s Central Coast farm.

Court documents revealed the 53-year-old called his brother a f**king grub, a cockroach and a dickhead, and threatened to “crush his skull”.

Magistrate Ron Maiden didn’t issue Monteiro a penalty with the conviction because he had already been sent back to jail for breaching a court order designed to stop him sexually assaulting more women.

The former model was last year found to have breached the order by using false names when signing in at a Sydney pub and gym.

The order was made in April 2019 when his parole was due to expire, after spending 10 years in jail for a 2008 rape.

In a brief mention in the District Court at Newcastle on Thursday, a hearing date was set for Monteiro’s appeal.

His lawyer Ross Hill will make the case on July 23 in a three-hour hearing.

Monteiro previously told the same court he “should never have been convicted” of the intimidation offence.

The Supreme Court in 2019 heard Monteiro had “serious violent tendencies”, “next to no prospect of rehabilitation” and was a “potential psychopath”.

The Crown Prosecutor said the reports from two doctors determined Monteiro also had a high risk of “sexual reoffending”.

A year later Monteiro told another court he studied Buddhism in prison and believed in “non-violence”.

‘Playboy’ rapist fights intimidate, stalk charges

A court has heard that Simon Monteiro, dubbed the “playboy” rapist, practised Buddhism during his time in jail and “didn’t believe in violent behaviour”.

Monteiro, 53, was back in Gosford Local Court on Tuesday fighting two charges of stalk or intimidate intending to cause fear or physical/mental harm.

Charge sheets state that Monteiro allegedly intimated both his older brother Brett Lowe and Mr Lowe’s wife Sandy-Ponumas Lowe on March 30 2019.

The court heard the charges, to which Monteiro has pleaded not-guilty, relate to a phone conversation between Monteiro and Mr Lowe where Monterio allegedly said “I’d f**king like to crush your skull, you f**king grub”. An audio recording played in court also appeared to show Monteiro call his eldest brother a “cock sucker” and “cockroach”.

“I’m not going to say what I’m going to do, I’m just going to do what I am going to do,”

Monteiro is allegedly heard saying in the audio recording.

The second charge relates to a conversation between Monteiro and Mrs Lowe a few hours earlier when she was gardening at his father’s 15 acre property in Somersby.

Mrs Lowe alleges he was aggressive and frightened her during the conversation when he was asking for his brother’s phone number.

Monteiro appeared in court via audio visual link from Parklea Correctional Centre, after being sent back to jail last week on charges of breaching a strict court order aimed at stopping him sexually assaulting any more women.

The former male model, who spent 10 years in jail for raping a former girlfriend, breached the order by using false names when signing in to a popular Sydney pub and a gym. He is awaiting sentence on September 30.

Monteiro told the court he just wanted his brother to pull his weight around the family farm owned by his 86-year-old dad. He said on March 30 he had a calm conversation with Mrs Lowe at the farm to ask for his brother’s phone number. When he called his brother that night, he lost his temper.

“They were empty words and said in the moment due to being outraged for not helping our dad,” he told the court.

“I approached Sandy because my father was really struggling, I’d noticed him limping around the property. I wanted my brother to go tend to the property. At no time did I raise my voice.”

Monteiro said he had practised Buddhism during is time in prison.

“I’m not saying I’m a Buddhist but I studied it in prison. It made positive changes in me and I believe in non violence,” he said.

During the hearing, Mr Lowe said he and his brother hadn’t gotten along for the past 20 years and only spoke on three occasions.

When Monteiro’s defence asked why he went to the police after the phone call, Mr Lowe said the term “crushing my skull” was not something he had heard his little brother say before.

“Yes, I take his threats seriously,” he told the court. “Simon has made a lot threats, some of them he carries out. Other times I didn’t go to police, I don’t think he’d be stupid enough to do anything to me. I’m not a woman, I’m not easy prey for him”.

The audio recording heard Mr Lowe responding “what are you going to do Simon?” and

“have you forgotten who you are and what you have done?”. Monteiro’s defence indicated he was baiting his brother.

“You were doing your best to see his parole was breached,” the court heard.

Mrs Lowe gave evidence, through a Thai interpreter, and said she spoke to Monteiro when she was tending to the vegetable garden at the property.

She said Monteiro was being aggressive and spitting when he spoke about how his brother should mow the lawns and had told neighbours he was a rapist.

Monteiro’s defence questioned why she was scared of him and she responded it was due to his tone. She added she had heard about his violent past “from the news, social media and from other people”.

The brothers’ father Rowland Lowe gave evidence in support of Monteiro saying his son had a calm conversion with Mrs Lowe on March 30.

Monteiro’s girlfriend Carol Langley also gave evidence, saying at one point this year Brett and Sandy Lowe pulled up beside them at the property where they were working on a community garden. She said Mr Lowe said “we are not afraid of you”.

As she left court she blew Monteiro a kiss and he was visibly emotional.

Magistrate Ron Maiden adjourned the matter to October and requested transcripts of the phone conversation between the brothers.
