A young man told Corrective Services officers “let’s go” and banged his head against the glass dock during a tense stand-off which forced a magistrate to close the court.
Bailey Peters-Mitchell, 26, of Woy Woy, faced Gosford Local Court on Wednesday where his Legal Aid solicitor applied for bail.
He told the court Peters-Mitchell had mental health conditions, which required medication, strong community ties and could abide by strict bail conditions.
It comes after police raided a Kariong property on Tuesday and arrested Peters-Mitchell and two other men over an alleged aggravated break in at Chittaway Tavern in which a cash redemption terminal was stolen.
Magistrate Elizabeth Ellis said Peters-Mitchell was on parole and an intensive correction order for previous offences and had a litany of warrants on his record for breaching bail and failing to appear at court.
But when Ms Ellis refused him bail, Peters-Mitchell became agitated and started saying “where’s the evidence?”.
“Excuse me, how can you say the prosecution’s case is strong? Where’s the evidence,” he repeated until the magistrate closed the court.
Peters-Mitchell stood up in the dock and turned his attention to Corrective Services staff who he told “let’s go”.
Correctives tried to calm him but Peters-Mitchell refused to come out of the dock and at one point banged his head violently on the glass telling them he needed to be medicated and would be spending “years in jail” before his matter was finalised.
His partner, who had been in court, also tried to calm him until he eventually backed down and complied with officers after about 15 minutes.
He will face court again, via video-link, on May 30.
Charge sheets allege Peters-Mitchell and two other men broke into Chittaway Tavern about 3.45am on Tuesday and stole a cash redemption terminal.
Police will allege the terminal, which is used to pay out pokie winnings, was put on a trailer being towed by a silver Toyota SUV.
A short time later, emergency services were called to a vehicle fire on the M1 at Ourimbah which was confirmed to be the vehicle used in the break and enter.
Following extensive inquiries, officers attended a home on Langford Drive, Kariong, about 8am on Tuesday.
Upon police arrival, officers stopped and spoke with Brenton Neil, 29, of Chittaway Bay, who was observed leaving the premises.
During a subsequent search of the man, officers allegedly located and seized $50,000 cash.
Neil was arrested with Peters-Mitchell and another man, James Miller, 29, of Kariong.
All three were charged over the alleged cash terminal robbery while Neil and Miller were also charged with dealing with proceeds of crime.
A search warrant was conducted at the Kariong property, with police seizing other items of interest including a money counter, tools, and safes.
Neil and Miller were also refused bail to face Gosford Local Court on Wednesday.
Neil’s solicitor did not apply for bail and it was refused and Miller applied for bail but it too was refused and both men were adjourned to face court again in May.
