A man who spent three hours a day watching pornography and masturbating to deal with loneliness and depression from caring for his elderly parents escalated to downloading child abuse material, a court has heard.
Peter John Cincotta, 59, of Bateau Bay, faced Gosford District Court on Monday where he was sentenced to three years jail with a non-parole period of 18 months.
Cincotta pleaded guilty to two charges of using a carriage service to access and possess child abuse material.
An agreed set of facts state police raided Cincotta’ Redgum Close house on January 11 last year where they seized an Acer laptop under the bedside table in his room.
When he was cautioned by police, Cincotta said he had “an idea of what it’s all about”.
“It was just curiosity more than anything,” he told police.
A forensic examination of his laptop found of the nearly 1000 files, 421 of those were child abuse material.
Further checks revealed Cincotta had been using a free peer-to-peer file sharing networking application to “search for and download files depicting child abuse material”, the facts state.
Cincotta accessed the app 19 times between November 24, 2024 and his arrest just under two months later with 36 files in the process of being downloaded when police came knocking on his door.
“During the offending period the offender accessed a total of 294 files depicting child abuse material being 204 images and 91 videos,” the facts state.
The court heard Cincotta was working as a salesman for a small electronics wholesaler as well as caring for his elderly parents at the time.
A psychologist’s report states Cincotta was watching pornography and masturbating up the three hours a day when he first stumbled across child abuse material.
Cincotta told the psychologist pornography was “taking over my life” but he denied having a particular interest in child abuse material and maintained it was more of a “curiosity”.
“While he denied any specific sexual interest in children, his regular use of pornography for sexual gratification and the volume of files containing child abuse material does raise concern regarding the development of a pedophilic arousal pattern,” the report states.
The court heard the majority of the files accessed by the offender had explicit and descriptive titles which reference the participants’ age and nature of sexual activity.
In her written submissions the Crown prosecutor described the material as “particularly depraved”.
With time served since his arrest last year, Cincotta will be eligible for release on July 10.
