A man was on parole for unrelated firearm offences when he allegedly assaulted his girlfriend multiple times before he was eventually arrested and then allegedly threatened her again from jail.
Jason Joseph Zammit appeared via video link at Wyong Local Court on Tuesday where he is facing 21 alleged charges of assaulting, intimidating and recklessly damaging his girlfriend’s property.
The 34-year-old from Marayong, near Blacktown, was charged with allegedly assaulting his girlfriend, causing her actual bodily harm, twice in October last year at Lake Macquarie.
He was charged with assaulting her, intimidating her and damaging her silver Mazda sedan a further three times in November.
Charge sheets tendered in court allege Mr Zammit smashed her Samsung mobile phone and assaulted her on December 11 before police took out an apprehended violence order (AVO) for the woman’s protection.
Mr Zammit allegedly contravened the AVO and intimidated her on Christmas Eve before he allegedly caught up with her at Tuggerah on December 27 and assaulted her, damaged her car again and further intimidated her.
His Legal Aid solicitor Kara Grimsley applied for Mr Zammit’s charges to be withdrawn and dismissed because they had more than passed the six-month deadline for the police prosecutor to file a charge certificate and finalise the offences the Crown intended to proceed with.
She said the case was not “particularly complex” and it was “just unacceptable” for Mr Zammit to remain in custody eight months later without knowing specifically what charges he was facing.
Ms Grimsley also applied for bail.
The police prosecutor however said it wasn’t the case that “no progress has been made” and that police were still in the process of laying further charges including that Mr Zammit had allegedly “choked” his partner in December.
He told the court Mr Zammit was also charged with contravening the AVO and intimidating his partner when he called her from custody at Silverwater and allegedly told her he would “get away with it”, “I will rape your mother too” and “I’m going to f..king murder you too you f..king slut”.
Magistrate Robert Munro said the matter involved “very serious allegations of domestic violence” and he was concerned if Mr Zammit was released that he would “continue to endanger the safety of the victim”.
He refused bail and rejected the application to have the charges withdrawn before adjourning the matter to September 5.
