Imogen McCutcheon, 18, enters plea over dangerous driving charge after hitting motorcyclist in Umina Beach

Imogen McCutcheon, 18, didn’t see a motorcyclist on the road until he crashed into the windscreen of her car in Umina Beach. She has entered a plea in court over dangerous driving.

A young driver said she didn’t see a motorcyclist before “suddenly her windscreen smashed” in Umina Beach.

Imogen McCutcheon, 18, appeared at Gosford Local Court on Wednesday where she pleaded guilty to one charge of dangerous driving occasioning grievous bodily harm.

The charge related to a collision between Ms McCutcheon’s Toyota Yaris and a motorcyclist on the intersection of West St and Leslie St on November 15 2021.

Ms McCutcheon, of Umina Beach, sat quietly in court supported by her father when her plea was entered by her lawyer. Two charges of negligent driving were withdrawn.

An agreed set of facts tendered to the court state that around 9.20pm on November 15 2021, Ms McCutcheon was driving her Toyota Yaris on West Street in Umina Beach.

The 31-year-old male victim was on a KTM motorcycle and driving 50km/h.

“The accused activated her indicator and proceeded to turn right from West Street to Leslie Street, turning into the direct path of the victim,” the facts stated.

“The victim attempted to avoid the accused and braked but was unable to stop and collided with the front of the car. The impact with the front of the Toyota Yaris ejected the victim from the motorcycle as the side of his body made contact with the windscreen of the vehicle causing it to smash.”

Police arrived at the scene to find the victim lying in the middle of the intersection of West St and Leslie St with a compound fracture to the lower left leg.

He was taken to Gosford Hospital for further treatment with injuries including hip bruising, internal bruising to his abdominal area, fractured fibula and compound fracture of the left tibia.

Police spoke to Ms McCutcheon at the scene.

She told police she had not seen the motorcycle before taking the turn and then suddenly her windscreen smashed.

Ms McCutcheon returned a negative breath test.

“At the time of the collision the road was lit with lighting, the road was dry sealed bitumen and the traffic was light,” the facts stated.

Magistrate Jennifer Price ordered a sentencing assessment report and victim impact statement ahead of Ms McCutcheon’s sentence on August 15.
