Hamlyn Terrace: Man wanted after police shooting arrested and charged

He allegedly sparked a massive manhunt on the Central Coast after a fatal shooting by police but now Josh York is in police custody, after he was convicted over the violent assault of his own daughter.

A man has been arrested on outstanding warrants as investigations continue into the fatal police shooting of Josh Duke on the Central Coast last week.

A critical incident investigation, which is being led by detectives from the Homicide Squad, was established after 37-year-old Duke was shot dead by police at Hamlyn Terrace on Thursday, October 15.

As part of the investigation, detectives from the Robbery and Serious Crime Squad were conducting inquiries into the whereabouts of a 46-year-old man, who was wanted on a number of outstanding warrants.

Following extensive inquiries, the man was arrested at a home on Willow Rd, Springfield, about 6.30pm on Sunday, October 18.

He was taken to Gosford Police Station, where he was charged with assault occasioning actual bodily harm (domestic violence), intimidation and two outstanding warrants.

Joshua Samuel York appeared at Gosford Local Court where he briefly applied for bail on Monday.

However he took advice from his Legal-Aid solicitor and withdrew his bail application after Magistrate Alan Railton heard there had been a warrant out for his arrest.

The court heard York, a panel beater, had failed to appear on September 11 2020 when he was convicted in his absence of stalk/intimidate, common assault, contravene restriction in AVO and driving motor vehicle while disqualified.

Facts tendered to the court revealed in September 2019 York asked his 18-year-old daughter for a head massage and when she refused he said “you’re a filthy slut”.

He then pushed her against a wall, covered her mouth with his hand and said, “be quiet, be quiet, if you don’t be quiet I’m going to kill you”.

The victim stated she couldn’t breathe and everything went “blurry and black and my heart stopped”.

Magistrate Railton adjourned the matter for sentencing until October 29.

It comes after police were called by members of the public about 9.50am last Thursday following reports of a stolen Toyota Landcruiser.

Witnesses followed the stolen vehicle until it allegedly rammed their car and police began a pursuit.

Police lost sight of the vehicle when it turned down a fire trail and drove into the rear of a rural property off Minnesota Rd, where it was set alight.

The property owners reported the fire and police arrived a short time later where they were confronted by Joshua Duke who pointed a double barrel shotgun at them before a number of officers fired their weapons.

Duke died at the scene.

Following the shooting, a widescale search was launched for another man who police believed could also be armed.

Dozens of officers, the Dog Unit, heavily armed Public Order Riot Squad officers and the Police Helicopter spent most of the day searching for Joshua York.

He was arrested on Sunday at Springfield and charged with outstanding offences but he has not been charged in relation to last week’s alleged pursuit.

Investigations are into the critical incident are continuing.

All information will be provided to the Coroner who will determine the cause of death and make any findings about the events leading to the man’s death.
