A truckie lifted his robe to expose himself to his neighbour across the road and then creepily put his finger to his lips as if to say “shoosh” when she looked straight at him, a court has heard.
Darren Perce Wilson, 56, of Hamlyn Terrace, faced Wyong Local Court on Wednesday where he pleaded guilty to one count of exposing himself to his unsuspecting neighbour.
An agreed set of facts states the victim lived directly across the laneway from his house with her kitchen window facing his front bedroom window.
Shortly before 8pm on May 4 the woman noticed movement outside, in her peripheral vision, and looked out to see Wilson standing at his bedroom window.
“On a closer look, the victim realised the accused was exposing himself looking directly at the victim,” the facts state.
The victim began recording him on her mobile phone.
“The footage shows the accused standing in the window of his well-lit bedroom, lifting his robe and exposing his penis,” the facts state.
“The accused is seen twice within the video to put his left index finger to his lips in a ‘shoosh’ motion, to suggest he wanted the victim to be quiet about his actions.
“It appears the accused soon realised he was being filmed and conceals himself before dimming the lights in his room.”
The woman called police who attended the next day and she provided them with the vision.
They went across the laneway and spoke to Wilson who initially said he’d heard a noise outside and opened the window to have a look.
“Police showed the accused the mobile phone footage when he became visibly nervous, shaking, swallowing constantly and flicking his fingers,” the facts state.
“The accused said to police ‘tell her I’m sorry and I’ll close the blinds’. The accused continued to fidget nervously before stating ‘I’ll get f--king divorced’ and ‘tell her I’ll keep them closed, tell her something please’.”
The court heard Wilson had previously been charged and convicted four times for behaving in an offensive manner in public and three times for wilful and obscene exposure.
Wilson’s lawyer, leading Central Coast criminal solicitor Ryan Finch, told the court it had been 13 years since Wilson’s last conviction for flashing.
Mr Finch said Wilson was undergoing psychological counselling — along with treatment for alcohol abuse — to see if there was any underlying or undiagnosed mental health reasons, which compelled him to remove his pants in view of the public after a few drinks.
Mr Finch said Wilson was a professional truck driver with strong community ties who was drinking whiskey at the time while his wife and kids were out.
Magistrate Trevor Khan said the circumstances of this offence were at the lower end of objective seriousness but it was troubling that Wilson had so many similar offences on his record, albeit some time ago.
Mr Khan convicted Wilson, fined him $1000 and put him on a two-year community correction order with 120 hours of community service.
