Daryl Michael Evans hacked ex’s Facebook, sent her nude pics to friends

A Central Coast man has been jailed after sending nine photos and one video of his ex-girlfriend masturbating to her entire Facebook friends list including her mother, father and family.

A woman was left “curled up in a ball shaking and freaked out” when messages from friends and family started rolling in about naked images she had sent them.

Only the victim never sent the nine pictures and one video of herself masturbating.

It was her ex-boyfriend of eight months who had hacked her Facebook account and sent her entire friends list the intimate images of her in various positions, a court has heard.

Daryl Michael Evans, 34, of Goulburn, faced Wyong Local Court on Friday where he was sentenced to a maximum 14 months jail, with a non-parole period of nine months for intentionally distributing intimate images without consent.

Magistrate Michael Barko said the legislation was not new and described Evans’ offending at the “upper end” of objective serious for this type of offence.

He said he did not know if police contacted every recipient of the images to make sure they were deleted but doubted if they had been totally removed from the “world wide web”.

“There’s probably somebody masturbating in a toilet over those images,” he told Evans.

An agreed set of facts tendered in court stated Evans was in an eight-month relationship with a woman, which ended when he was incarcerated.

On his release the woman contacted him in May last year and asked him to delete all the photos and videos he had on a shared iCloud account, which only he could access.

The photos included naked images of herself and of herself masturbating.

The victim said: “I need you to delete my Facebook off your iCloud and while your at it, delete all those photos, you promised you would”.

The accused said “why are you doing this to me?” but she ended the conversation.

“The accused hung up the phone and again logged into the victim’s Facebook profile and sent nine (9) photos and one (1) video of the victim to her entire contact list, which included her father, her mother and other family members,” the facts read.

The accused then went onto his Messenger account and messaged the victim saying “That’s what you get for being a lying peace (sic) of shit”.

However the victim did not receive the message because she had blocked him.

“The victim curled up in a ball was shaking and freaked out as messages from friends and family started being returned about the photo’s,” the facts read.

Later that day Evans messaged a friend where he admitted sending the photos.

“The accused said, `I’m probably going to go back to jail. I sent my ex’s entire friends list videos of her f...ing herself. I’m more then likely going to go to jail again’,” the facts read.

She contacted police who told her to come into the station to report the matter.

“The victim was extremely humiliated by the incident and could not attend the station to talk about it at the time,” the facts read.

On July 1 the woman reported the incident to Goulburn Police Station where she provided a statement and screen shots of images sent by Evans.

About 1.15pm on September 18, 2019, Evans attended Wyong Police Station where he declined to be interviewed.

Evans’ solicitor told the court he had previous drug problems but had been clean for 16 months and was helping raise his new partner’s infant child.

His solicitor said he was homeless at the time of the offence and he had since got himself a job and was paying off debts.

She said Evans had also contacted the victim and apologised.

However Mr Barko said Evans was on parole at the time of the offence and had exhausted every sentencing option available in his 14-page criminal history.

Evans will be eligible for parole on December 19.
