Brittney Tate avoids jail for slashing her sister with a steak knife in Charmhaven

A woman has been ordered off the grog for 18 months after slashing her sister when she was accused of sleeping with her sister’s boyfriend.

A woman who slashed her sister after she was accused of sleeping with her sister’s boyfriend has been sentenced to a community corrections order.

Brittney Tate faced Wyong Local Court on Wednesday after being charged with recklessly wounding her sister Toyah Isabel Tate in the early hours of Sunday December 14.

An agreed set of police facts, tendered to court, state Brittney, 23, and her older sister Toyah, 28, were living at the same property on Norah Ave, Charmhaven, with their mother at the time.

The night before the older sister “became aware that the accused had had an intimate relationship with her boyfriend Caleb Thompson”.

“The victim confronted the accused about it and a heated argument ensued,” the facts read.

During the argument the pair scuffled, fell over and broke a coffee table.

Brittney returned to the granny flat where she lived at the back of the property and the “situation de-escalated”.

Shortly after 9pm on Saturday Brittney rang police and said she had been “hit in the lip” but when police arrived no one was answering the door of the main house or the granny flat.

Police rang Brittney eight times but she did not answer.

About 1am on Sunday Brittney entered the main house and started to scream at her older sister.

“The accused had a serrated steak knife in her hand and began to run at the victim,” the facts read.

They both ran out of the house and onto the driveway.

“The accused has swung the knife in the direction of the victim and cut her right bicep,” the facts read.

“The laceration was about 8cm long and deep enough ... exposing deep tissue.”

Brittney dropped the knife and fled.

Toyah rang police and allowed officers to take a photograph of her injury but refused to give a statement.

“She stated she only called police to get the accused to go to bed and she did not want any more action taken,” the facts read.

She was taken to Wyong Hospital during which police were able to get her version of events recorded on body worn camera.

Brittney was arrested with police noting she was unsteady on her feet, slurring her words and smelled of intoxicating liquor.

She admitted to drinking “a lot” that night, the facts stated and that she was so drunk she was “unable to answer any police questions”.

Magistrate Elizabeth Ellis sentenced Brittney to an 18-month community corrections order, a condition of which is to abstain from drugs or alcohol.

She also has to reside at an address at the Entrance North.
