A woman, who was aged 19 when she allegedly lost control and ploughed into a tree killing her 17-year-old brother, has been charged with swearing and intimidating police.
The woman, 20, who cannot be named for legal reasons, faced Wyong Local Court on Tuesday which heard she had been arrested and charged with two fresh offences the previous day.
Charge sheets allege the woman was at Wyong Police Station about 4.30pm on Monday, January 6, when she let fly with a series of vulgar swear words at an officer manning the front counter.
The woman was arrested and charged with swearing in a public place and intimidating an officer in the execution of their duty.
Her solicitor told the court his client would likely make an application to have the intimidation charge dealt with under mental health provisions.
The court heard the woman was already facing serious allegations after being charged with dangerous driving occasioning the death of her younger brother at 1.35am on July 31, 2024.
Charge sheets allege the suspended driver was behind the wheel of a black Holden Commodore station wagon when it left the Pacific Highway at Charmhaven and slammed into a tree.
The woman was also charged with failing to stop and assist after she fled the scene on foot.
On Tuesday her solicitor told the court the fresh charges involved an “unrelated matter” but sought ”the court’s indulgence” to have both matters adjourned to a later date.
The court heard the results from her brother’s post mortem, as well as other inquiries, were still outstanding but the Office of the Director of Public Prosecutions anticipated it would have enough material to certify the charges by the next court appearance.
The woman’s bail was continued and she was adjourned to reappear on March 4.
She is yet to enter any pleas to any of the charges.
